Our tenancy work for clients includes:

  • the interpretation of the agreement in question

  • advice on either the landlord’s or the tenant’s contractual or statutory rights or obligations, including in relation to any deposit paid by the tenant

  • the resolution of any disputes arising between the parties

  • the service of any possession notices, and

  • the conduct of possession claims and enforcement of possession orders.

The law relating to residential tenancies is updated frequently. As experts in our field, we ensure that the correct procedure is followed by a landlord who wishes to seek possession of their property, to minimise any disputes or challenges, and thereby minimise costs, at a later date. 

Where disputes arise, we often assist in achieving negotiated settlements with tenants or occupiers, where that is the desired outcome, which may, for example, result in compliance with the tenancy terms complained of or a voluntary surrender of the tenancy. Such an outcome is often achieved at a minimal cost.

We advise on and assist landlords and their agents with all residential tenures including:

  • Assured or Assured Shorthold Tenancies (ASTs) under the Housing Act 1988

  • Protected or statutory tenancies under the Rent Act 1977

  • Secure tenancies under the Housing Act 1985, and

  • Non-Housing Act 1988 tenancies.

We advise on and assist with non-standard agreements such as licences (for example, a lodger) or others occupying residential premises, whether or not they have a right to do so (such as squatters).
